Terms and conditions

These terms and conditions govern the mutual rights and obligations between the seller and the buyer in connection with the purchase of kits, accessories and custom-built models via the website www.jkmodels.cz.

1. Seller

The seller is a sole trader registered under the Czech Trade Licensing Act, VAT registered.

2. Scope

1. The seller offers kits of giant scale RC aircraft models, CNC cuts, accessories and modeller tools, and provides custom-built flying and static models on order.
2. Product descriptions and technical specifications are listed for each item in the catalogue on the website.
3. Product photographs are illustrative and may differ slightly from the actual item (especially for handcrafted goods).

3. Order and contract formation

1. The buyer places an order via the shopping cart or by submitting a non-binding inquiry for items with price on request.
2. Before submitting the order, the buyer can review and edit the information entered.
3. By submitting an order the buyer confirms that they have read and agree to these terms.
4. The contract is formed when the seller sends the buyer an order confirmation to the e-mail address provided.
5. For custom builds the contract is formed after both parties agree on the price quote, schedule and technical specification (typically by written order or e-mail).

4. Price and payment

1. Prices in the catalogue are inclusive of VAT.
2. For items labelled „Price on request“ the price is set individually based on inquiry and specification.
3. Payment options: bank transfer (proforma invoice, due in 7 days), cash on delivery, cash on personal collection.
4. For custom builds the standard payment is split: 50% deposit on order confirmation, 50% on delivery. Specific terms are part of the price quote.

5. Delivery

1. Catalogue kits are usually shipped within 5–15 working days from payment. Custom orders have an individually agreed lead time.
2. Place of delivery is the address given in the order. We ship via Czech Post, PPL or personal delivery.
3. The buyer must confirm receipt. Any visible transport damage should be recorded with the carrier and reported to us immediately.
4. Ownership of the goods passes to the buyer upon full payment of the purchase price.

6. Right of withdrawal (consumer)

1. A consumer has the right to withdraw from the contract without giving reasons within 14 days of receiving the goods (§ 1829 of the Czech Civil Code).
2. Any clear declaration delivered to the seller (e-mail, letter) is sufficient. Goods must be returned without undue delay, within 14 days at the latest.
3. The cost of returning the goods is borne by the buyer.
4. The seller will refund the paid purchase price (including delivery costs) within 14 days of withdrawal, by the same method of payment.
5. Right of withdrawal does not apply to goods made to the buyer's specifications (custom builds) — § 1837 letter d) of the Czech Civil Code.

7. Warranty and complaints

1. Liability for defects is governed by the relevant provisions of the Czech Civil Code (§ 2161 et seq.).
2. Consumers may claim defects appearing within 24 months of receipt. For business buyers the warranty is by agreement (usually 12 months).
3. Complaints can be submitted by e-mail or post to the seller's address. They will be processed without undue delay, within 30 days at the latest.
4. The warranty does not cover normal wear, damage caused by improper use (crash damage, wrong operation, faulty assembly) or defects caused by the buyer's modifications.

8. Personal data protection

The processing of personal data is governed by the Privacy policy, which is an integral part of these terms.

9. Cookies

Information about cookies is available in the Cookies policy.

10. Final provisions

1. These terms are governed by the laws of the Czech Republic, in particular the Civil Code and the Consumer Protection Act.
2. The seller reserves the right to amend these terms. The terms valid at the time of order submission apply to that order.
3. If any provision becomes invalid, the remaining provisions remain in force.
4. Consumers may turn to the Czech Trade Inspection Authority for out-of-court dispute resolution.
